Nearly two years ago, a horrific accident tragically took the lives of four people and severely injured one other individual. The collision quickly became infamous, capturing the attention of local and national news stations.

Sometimes a personal injury plaintiff sues the individual they believe to be liable for their injury, and also the individual's government employer. Under Texas law, the plaintiff may sue both the government employer and the employee, as long as certain requirements are met.

In the case of In re Essex Insurance Company, a worker lost his hand while operating a tortilla machine at his place of business. He filed suit against both the business and their insurance company, seeking to recover damages for his injuries. The insurer defended the action by stating that the man was an employee at the time of the injury, and thus the commercial liability policy that covered the business did not apply to his injury. The man maintained that he was an independent contractor and not an employee.

During 2011 in the United States during 2011, more than 650 children under 12 years of age died in car crashes while more than 148,000 were injured. A study conducted by the CDC found that, in one year, more than 618,000 children between the ages of birth to 12 years rode in vehicles without the use of a child safety seat, booster seat, or a seat belt at least some of the time; of the children who died in a car accident in 2011, 33% were not buckled up.
